PRIVACY POLICY

This privacy policy (“Privacy Policy”) has been designed and created to explain the procedures and practices used by Newsflow, and its parents and affiliates (collectively “Newsflow”, “we”, “us”, or “our”) with respect to the collection, use and disclosure of certain information on and through our website, www.newsflowapp.com (the “Site”) and/or our mobile application (“Application”), and the services that we provide (collectively with the Site and the Application, the “Services”).

By accessing and using the Services, you (“you” or “your”) acknowledge and agree that you accept the policies set forth in this Privacy Policy as a condition of your use.

This Privacy Policy is subject to and governed by our Terms of Service (the “Terms”), available at www.newsflowapp.com. Your use of the Services is subject to your continued compliance with, and agreement to, the Terms. The terms of the foregoing document are hereby incorporated by reference. Any terms capitalized but not herein defined shall be given the meaning ascribed to them by the Terms.

I. Information We Collect Account Information

When you create an account (“Account”), you will provide information, such as your username, password and email address. When you create an Account, you may also provide us with certain financial information, which will allow you to make purchases within the Application. You acknowledge that this information may be personal to you and by creating an Account on the Services and providing such information to us, you allow others, including us, to identify you.

If you access the Services using your Google, Facebook, Twitter, or other third party account, we may automatically collect certain information, such as your name, picture, and email address. We will use all information available through Google, Facebook, Twitter or any other third party platform you use to access the Services, in accordance with the respective policies of these services and your preferences selected through them. We may use your contact information to send you information about our Services or when we believe it is necessary, such as for Account recovery purposes.

Automatically Collected Information

We may also collect, automatically, other non-identifiable information about you when you access the Services, including your Internet Protocol address, browser type and language, Internet Service Provider, information about your Wi-Fi or telecommunications connection (including, without limitation, 2G, 3G, and 4G LTE connections), operating system-provided information or user specific identification information for advertising tracking referring pages, and your usage of near field communication (if any). While this information is non-identifiable, we may aggregate such information based on your geographic location, and transfer such information to third parties in accordance with the terms of this Privacy Policy.

We automatically collect information pertaining to your use of the Services. This information may be used both anonymously and non-anonymously. For example, we automatically collect information pertaining to the articles you read, how far you scroll through various articles, when articles are shared, when you comment on articles, and similar information. This information may be used anonymously to conduct analytics to help us improve the Services, as set forth in Section III, below. This information may also be used non-anonymously to provide you with your own use history, allow you to save articles using your Account, and to otherwise optimize your user experience.

The Application requires permission to read and write upon the storage drive of your device. By using the Services, you agree to provide us with permission for the foregoing.

Some mobile devices allow us to collect information about the contacts on your device. This information may be collected when available, but often cannot be collected from current generation smartphones and tablets. We will ask for your permission before collecting this type of information.

Location Data

We may collect data about your location while you are using the Services. We may link location data to other information we have collected about you. You may stop sharing your location data by adjusting your mobile device’s location services settings. For instruction on changing the relevant settings, please contact your service provider or device manufacturer.

II. How We Collect Information

In order to enhance your online experience, we use various technologies to collect the information described above, which may include the use of cookies, SDK’s and similar tracking technologies, as provided below:

Cookies

Cookies are small data files stored on your computer’s browser or device that store your preferences, enabling our website to recognize your browser and capture and remember certain information including user authentication, user preferences or language preferences. Cookies usually include an anonymous unique identifier and cannot retrieve any other data from your mobile device or pass on computer viruses.

You may be able to disable cookies in your browser or set up your browser to warn you before accepting certain cookies. Please note that if you disable cookies, some features the Services may become difficult or impossible to use.

Software Development Kits (“SDKs”)

We may sometimes use or partner with publishers or app developer platforms that use mobile SDKs, or use an SDK with our Application, to collect information such as mobile identifiers, in order to provide us with information on user devices and how those mobile devices might interact with our Services. We may also use this technology to deliver certain advertisements through the Services based on information associated with your mobile device, as more fully set forth below.

By using the Services, whether as a registered user or otherwise, you acknowledge and agree that you are giving us your consent to track your activities and your use of the Services through the technologies described above, and that we may use such tracking technologies in the emails we send to you.

III. How We Use Information

We strive to provide you with the best possible Services. Accordingly, we may use the information we collect to provide, analyze, administer, enhance and personalize our services and marketing efforts, to create your Account, and to communicate with you, and to allow you to communicate with others, on these and other topics. By way of example, we may use your information to: • Determine your general geographic location, provide you with personalized news content, and quickly and efficiently respond to inquiries and requests; 

  • Analyze your usage of the Services, and the way you interact with the Services, to help us understand our audience, improve the Services, and optimize the delivery of content to you;
  • Prevent, detect and investigate potentially prohibited or illegal activities, including the enforcement of our Terms; 
  • Provide you with relevant advertising content, as required by certain Service Agreements (as such term is defined below) that we maintain with third parties; and
  • Communicate with you concerning the Services (for example, by email) so that we can send you news, details about new features of the Services, special offers and promotions, and to assist you with operational requests.

We use these technologies to help provided the Services to you and in order to save your profile and preferences for future visits or compile aggregate data about website traffic and interaction so that we can offer a better user experience and tools in the future. Further, these technologies also help us deliver ads for relevant products and services.

IV. Information Disclosure

We may disclose your information for certain purposes, and to third parties, as described below:

Disclosure to Newsflow Agents and Employees

We may disclose your information to our agents, employees, contractors and affiliates for the purpose of providing and improving the Services, as set forth above. For the avoidance of doubt, this includes disclosures which help us improve the Services, administer operation requests (such as technical support), and deliver content to you.

Disclosure to Third Parties

The Services are the product of our efforts to aggregate news from thousands of trusted news sources. To deliver our services, we have partnered with trusted third parties, including other companies, agents, and contractors (collectively, “Service Providers”). We maintain agreements with our Service Providers (“Service Agreements”) which may, from time to time, require us to disclose information we collect, as necessary to provide the Services. For example, we may be required by our Service Agreements to provide user and usage information to our commercial partners, as well as information which allows us to provide marketing, advertising, and IT services, and to provide customer service.

While our Service Providers may have access to your personal information, we do not authorize them to use or disclose your personal information, except in connection with providing the Services. We may disclose your non-identifiable information to our trusted partners who shall comply with this privacy policy and the relevant privacy laws, which allow us to collaborate with our partners to conduct analysis of users’ behavior so as to promote our Services.

Your personal information, whether public or private, will not be sold, exchanged, transferred, or given to any other person or entity for any reason whatsoever, without your consent, except as expressly provided by this Privacy Policy.

Compliance with Laws

Newsflow and its Service Providers may disclose and otherwise use your personal information as reasonably necessary to (i) comply with applicable laws, regulations, legal processes (including, but not limited to, court and administrative proceedings), or by government request; (ii) to detect, prevent, or otherwise address illegal or prohibited activities; or (iii) to protect against harm to the rights, property, or personal safety of Newsflow, users of the Services, the Service Providers, or the public.

Change of Control

We may be required to release or otherwise disclose your information in connection with any reorganization, restructuring, merger, sale, or other transfer of all or part of our business, as permitted by applicable law. In such case, we will transfer your information, including personal information, as permitted by applicable law.

International Disclosures

If you are located outside of Hungary, you use this Service at your own risk. We operate in Hungary and elsewhere, so it may be necessary for us to transfer your information internationally. By using the Services, you acknowledge that the data protection and privacy laws of other countries, may provide a less comprehensive or protective standard of protection than those in Hungary, and you consent to your information being collected, processed and transferred as set forth in this Privacy Policy. Whenever, in the course of sharing information, we transfer personal information to countries outside Hungary (or other regions with comprehensive data protection laws), we will ensure the information is transferred in accordance with this Privacy Policy, as permitted by applicable laws regarding data protection.

V. Security of Information

Newsflow is committed to protecting the security of your information. As such, we use security controls to protect your information from loss, misuse, unauthorized access, disclosure, alteration and destruction. Further, any information we receive is stored on one or more secure servers, and access to our information systems requires user authentication via password or similar means. Despite these precautions, no data security system is impenetrable, and as a result, we cannot ensure the security of information during its transmission between you and us; accordingly, you acknowledge that you do so at your own risk.

If Newsflow learns of a security system breach, we may attempt to notify you and provide information on protective measures, if available, through the email address that you have provided to us or by posting a notice on our website.

VI. Miscellaneous Initial Dispute Resolution

We aim to address your concerns without the necessity of a formal legal claim. Before filing a claim against Newsflow, you agree to try to resolve the dispute informally by contacting us support@newsflowapp.com. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, either you or Newsflow may begin formal legal action, subject to the terms of this Privacy Policy.

Choice of Law. 

The validity, performance, construction, and interpretation of this Agreement shall be governed by the laws of Hungary. With respect to any disputes which cannot be resolved by our internal processes, and subject to the mandatory arbitration provision herein, you agree that jurisdiction for any legal action will be the state courts located in Budapest, Hungary. The parties hereby consent to the personal jurisdiction of such courts as described above.

Waiver of Class Action

You agree that any disputes against Newsflow are likely to be of a unique character, such that the aggregation of claims shall not constitute an effective method of dispute resolution. Accordingly, you expressly waive, disclaim, and forever discharge any right you may have to engage in a class action dispute against Newsflow.

Attorneys’ Fees and Costs

In any legal action hereunder, the prevailing party shall be entitled to attorney’s fees and costs.

Money Damages Sufficient

You expressly agree that money damages are sufficient to compensate you for any dispute arising under this Privacy Policy. Accordingly, you expressly disclaim any right to non-monetary relief, including, but not limited to, equitable or injunctive relief, that you may have in connection with a dispute arising under this Privacy Policy.

Changes to this Privacy Policy

We reserve the right to update or modify our Privacy Policy at any time, with or without notice. For example, we may amend or revise our Privacy Policy to comply with local, state, or Federal laws, to accommodate changes in technology, or to accommodate the needs of our users. We encourage you to review this Privacy Policy periodically so that you always know what information we collect, how we collect it, how we use and with whom we share it.

Other Miscellaneous Provisions

This Privacy Policy is governed by the same provisions as the Terms with respect to waiver, severability, assignment, modification, notices, and the relationship between you and Newsflow. To the extent that these provisions have not already been incorporated into this Privacy Policy, they are hereby incorporated. This Privacy Policy, and the Terms, constitute the entire agreement between you and Newsflow with respect to the subject matter hereto, and supersedes all prior representations, negotiations, promises, understandings or agreements, whether oral or written, between you and Newsflow with respect to the subject matter hereof.
